Terms and Conditions

RYDE is a mobile application ("RYDE") owned, maintained and controlled by Ibibo Group Private Limited ("Company"), a company incorporated and existing in accordance with the laws of India. By registering on RYDE, the end user ("User") acknowledges, accepts and agrees to abide by without limitation, below terms and conditions ("T&C") to view and/or use RYDE, which forms a binding contract between the User and Company. The Company will facilitate the process of payment and car pooling services for User on RYDE ("Services"). The Company may change, modify, alter or amend the T&Cs without notice at its discretion at any point of time.

1. General Conditions to use RYDE:

1.1 RYDE enables User to share a car for a journey with other User in exchange for a cost ("Ride Offeror") which may be accepted by another User for travelling from one place to another with the Ride Offeror and it may include all other co-Traveler/Users who accompany such User in the Vehicle for the Trip with Ride Offeror ("Co-Traveler").

The Vehicle is offered by the Ride Offeror for sharing car ride for a Trip in relation to which the Ride Offeror and the Co-Traveler have conducted a Transaction on RYDE which may be within the city or inter-city ("Trip"). Vehicle means a car which is legally owned by the Ride Offeror and has been offered for pooling a Trip on RYDE ("Vehicle"). Any confirmed Trip which is scheduled using RYDE by Ride Offeror and Co-Traveler shall be termed as ("Transaction") under the T&Cs.

1.2 Cost of the Trip which is to be shared between the Ride Offeror and Co-Traveler will be calculated by RYDE on the basis of distance and time of journey subject to final approval of the Ride Offeror ("Cost"). For the purpose of a particular Trip, cost contribution shall mean the individual share of Cost of each of the Co-Traveler as agreed between the Ride Offeror and the Co-Traveler in relation to the Trip which is payable by the Co-Traveler as their respective contribution towards the Cost of the Trip in advance to the Company ("Cost Contribution")

1.3 User must be above 18 years of age and should have contractual capacity at the time of registration on RYDE.

1.4 The T&Cs apply to any and all use of RYDE by a User, including without limitation whether such User is the 'Ride Offeror' or 'Co-Traveler'. By registering on RYDE, the User acknowledges, accepts and agrees to abide by the T&Cs.

1.5 User agrees that the Company may vary or amend RYDE, its Services, conditions, functionality, "look and feel" at any time without notice to User.

1.6 In the event, the User fails to comply with any of the T&C, the Company reserves its right to withdraw the User Account (defined below) in question and suspend or withdraw Services to User without any prior notice.

1.7 It is presumed that the person who has created the profile on ryde will be the one who will travel. In case of more than one booking s/he should be one of the travelers.

1.8 Ryde offerer may deny boarding in case the traveler profile does not match with the booking details. It is suggested that travelers should always carry a valid Photo Id Proof to avoid any confusion / dispute at the time of boarding.

1.9 The Name on your booking ticket / sms / email should match with the name on the photo id proof you are carrying.

1.10 It is optional and recommended that the users rate every other user they travel with, rating them with grades or leaving a comment about the shared ride. The Ratings are of exclusive use of the Company, in order to provide a better service to users.

1.11 By downloading and installing the Ryde app you agree to receive communication related to various promotional offers run by Ryde from time to time. The mode of communication can be either SMS, Email, Push or all of them. You can turn off these communications whenever you want though.

1.12 Ibibo Ryde provides the Users with the Ryde Platform to display the available rydes offered by Ryde Owner, for sale and purchase by other Users buying the Services on the Ryde Platform. Ryde may charge the Ryde Owner selling the seats, for the Services and/or the Indirect Services rendered from time to time. The fees payable by the Ryde Owners selling the seat, may include, listing fees, evaluation fees, commission on the seat sold, transaction processing fees, integration fees, any other fees as may be levied from time to time in relation to the Services and/or Indirect Services availed by such Ryde Owners. The Services and Indirect Services are governed by these Terms and Conditions and all applicable Policies of the Ibibo Ryde Platform, as may be amended from time to time and shall be deemed to be incorporated in these Terms and Conditions by way of reference. Unless expressly stated otherwise, any new features that augment or enhance the current Services and/or Indirect Services shall be subject to these Terms and Conditions.

2. Registration and verification on RYDE:

2.1 In order to use RYDE, each User must be registered on RYDE and create an account on RYDE ("User Account"). As a part of the registration process, User agrees to provide current, complete and accurate registration information and verification details (hereinafter referred to as "Registration Data") and keep it updated, complete and accurate throughout its use. User agrees to comply with the T&C and accepts that their personal data may be used, collected, stored or processed in accordance with the Privacy Policy of RYDE.

2.3 In order to be registered on RYDE, the User must complete the verification process by signing-in through his Facebook Account details thereby providing consent to capture details of User from Facebook Account which may be published on their respective User Account on RYDE. The final step of verification shall be completed with Mobile Verification of User on RYDE. Any personal picture of User retrieved from Facebook Account may be uploaded on User Account of respective User on RYDE. Only after confirmation of the User Account by the Company, the User can offer or book a ride on RYDE. However, User agrees and understands that the Company does not undertake any responsibility for the accuracy of the Registration Data and any other information provided by the User on the Application or to a Ride Offeror or Co-Traveler, as the case may be. The Company will not be liable to any User in any manner whatsoever in the event any information provided by another User results to be false, incomplete, inaccurate, misleading or fraudulent in nature. "Facebook Account" means the user account of User created on www.facebook.com.

2.4 Mobile Verification: In order to ensure credibility of User and to verify the User mobile number, the Company will send a SMS comprising of a four digit 'one time password' on the registered mobile number of the User. User needs to validate this four digit 'one time password' on RYDE in order to complete the process of registration and verification and to use or view RYDE.

2.5 The Registration Data uploaded by the User on RYDE may be used in any manner by the Company in connection with the Services at its sole discretion. After uploading Registration Data on RYDE, the User will be deemed to have given his consent for use of his Registration Data by the Company in accordance with the Privacy Policy of RYDE. User hereby forgoes and waives his rights to any claims whatsoever against the Company for use of Registration Data including User picture or other verification details.

2.6 If Company has reasonable grounds to believe that any information provided by the User is incorrect or incomplete, then the Company may suspend or terminate the User Account of the respective User temporarily or indefinitely at its discretion without notice to such User.

3. Use of Services:

3.1 Services offered by the Company will allow the User to share a Vehicle for a Trip either as a Ride Offeror offering the ride for carrying a Co-Traveler for that

Trip or as a Co-Traveler booking the Trip. The Transaction shall be done in exchange for a Cost Contribution. The Cost of the Trip will be shared by the Ride Offeror with all the Co-Travelers travelling in the Vehicle.

3.2 The Co-Traveler may contact the Ride Offeror directly for discussing any conditions of travel (including size of luggage allowed to carry, cancellation of Trip before or during the Trip etc.). After finalizing conditions of travel, the Co-Traveller will pay his share of Cost at the time of booking of ride to the Company and Company will reimburse the complete amount to the Ride Offeror within 3-4 working days from the date of confirmation of completion of trip from the Co-Travellers. The payout to the offeror will only happen in the form of bank transfer/NEFT by Ibibo Group .

3.3 If a Co-Traveller does not take the ride because of his personal reasons and not due to any deficiency on the part of the Ride Offeror, then Co-Traveller will not be entitled for any refund. However, partial refunds will be processed if the cancellation is requested by the Co-Traveller before the Ryde start time (irrespective of your pick-up time) and following percentage will be deducted from his Cost Contribution:

Within 120 minutes of the Ryde Start Time (irrespective of your pick-up time) 60%
Before 120 minutes of the Ryde Start Time (irrespective of your pick-up time) 30%

E.g. If a Ryde is scheduled to travel from source "A" to destination "E", irrespective of the pick-up time of passengers from boarding points B, C & D, cancellation policy would apply from the Ryde Start time from Source "A".

The above mentioned details in table may be modified or changed by the Company at its own discretion, without prior notice to User.

3.4 Parking, toll, interstate taxes, passenger taxes or any other applicable taxes and costs will be all inclusive in the Cost which will be shared between the Ride Offeror and the Co-Traveler.

3.5 All commercial and contractual terms are offered by and agreed to solely between the Users. The Company does not have any control and does not determine or advise or in any way involve itself in offering or approving such commercial and contractual terms agreed between the Ride Offeror and the Co- Travelers. User unconditionally acknowledge that given the nature of the Services and the fact that it is free of charge, the Ride Offeror and Co-Traveler will have no right to initiate any claim against the Company for any issue related to the Trip including, but not limited to, cancellation of Trip before or during the Trip, last minute changes, failure by the Ride Offeror or the Co-Traveler to show up and/or any other unsatisfactory or delayed performance by the Ride Offeror.

  1. (a) In case the Ryde does not start and/or user is not picked at the scheduled time, Ryde Customer Care should be reported immediately from the app to request full refund, within 4 hours of the Ryde start time. If failed, Ryde will be assumed as completed and any refund request thereafter would not be entertained.

3.6 Company has endeavored to ensure that all the information on RYDE is correct, but Company neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information contained within the content available on RYDE.

3.7 Company has no role and will take no steps to manage or schedule any booking and at no time any right, title or interest over the Transaction contemplated herein shall vest with the Company nor shall Company have any obligations or liabilities in respect of the Services offered by and agreed to solely between the Ride Offeror and the Co-Traveler. Company will also not be responsible for unsatisfactory or delayed performance by any User, including but not limited to, safety issues, cancellation of Trip, last minute changes, failure by the Ride Offeror or the Co-Traveler to turn up etc.

3.8 If a child sits on the guardian's lap then a separate seat booking is not required. However, if the child requires a separate seat then please book the seats accordingly for a convenient & uninterrupted travel experience.

3.9 Home Pickup Facility

  1. (1) Home Pickup is offered solely at the company's discretion and is provided only if passengers are within the permissible distance from the searched boarding point.
  2. (2) Home pick up can be denied for the reasons including, but not restricted to:-
    1. (a) Peak traffic hours
    2. (b) Narrow streets
    3. (c) Crowded market places
    4. (d) Weather conditions
    5. (e) Last moment change in the pick up point, and/or
    6. (f) If the driver feels that it would be best to avoid that pickup for his own or other passengers' safety.
  3. (3) Vehicle wait time will be a maximum of 5 minutes in case of home pick up, over and above which the driver reserves the right to move on with the pickup
  4. (4) You may be blacklisted as a result of misbehaving with fellow passengers/Ryde owner or forcing/abusing driver for pickup and you shall not be eligible to avail Ryde services in future.
  5. (5) IbiboRyde reserves right to deny home pick up if deemed so.
  6. (6) Failure of home pickup because of whatsoever reason does not arise the demand of any kind of refunds and the same shall not be entertained at all.

4. Limited use of Services on RYDE:

4.1 RYDE is merely providing a platform to a Ride Offeror and Co-Traveler for sharing a Vehicle in a private capacity in exchange of Cost between them. The User is only allowed to use RYDE for his personal use. Under no circumstances shall a User be permitted to use his User Account or details thereof for any purpose other than for using car pooling facility in India in his personal capacity and he shall not indulge in any activity of profit making or car sharing for hire or similar purposes.

4.2 The User agrees and undertakes not to exploit or abuse RYDE for any purpose other than the purpose herein and/or for any other purpose which is unlawful or illegal under any law for the time being in force within or outside the territory of India. In addition, RYDE shall not be used in any manner, which could damage, disable, impair or interfere with any other User's right to use and/or enjoyment of RYDE or cause any damage to or hamper the business or reputation of the Company. The User shall refrain itself from obtaining or attempting to obtain any information through any means which is not intentionally made available or provided to it for or through RYDE.

5. Obligations of the Ride Offeror and Co-Traveler:

  1. 5.1 Covenants & obligations of the Ryde Offeror - Failing to adhere to the said conditions, Ibibo reserves the right to hold/cancel all pending/current payouts arising from the completed rydes, indefinitely.
  2. The Ride Offeror hereby covenants that:
    1. (a) he is the legitimate owner of the Vehicle or is authorized and entitled to use the Vehicle under the laws of India;
    2. (b) the Trip is undertaken in his personal capacity in accordance with his need;
    3. (c) he will not use RYDE for any purpose which is unlawful or illegal under any law for the time being in force within or outside the territory of India for any fraudulent, unlawful or criminal activity;
    4. (d) he has procured for the Vehicle, a comprehensive insurance policy, which provides insurance cover to the Co-Travelers in the Vehicle and covers third party liability. The Ride Offeror further agrees that on the request of the Co-Traveler, he will provide the evidence to the Co-Traveler in respect of the subsistence of such insurance policy;
    5. (e) he holds a valid driving license and valid pollution control certificate in respect of the Vehicle;
    6. (f) he will present himself on time at the appointed pick up place as mutually agreed with Co-Travelers with the specified Vehicle;
    7. (g) he must wait for the Co-Travelers at the appointed pick up place for at least 10 (ten) minutes after the agreed time in case Co-Traveler fails to reach the appointed place on time;
    8. (h) he must take reasonable care to ensure good and humble conduct with the Co-Traveler during the Trip. Improper conduct means use of abusive language, driving under the influence of alcohol/drugs, driving rashly etc:
    9. (i) he will pay the amount of Cost Contribution to the Company at the time of offering the Trip on RYDE;
    10. (j) he will immediately inform the Co-Travelers about any change in respect of the proposed Trip for a Transaction. If one or more Co-Traveler have made a booking and the Ride Offeror decides to change any aspect of the Trip, the Ride Offeror undertakes to contact all Co-Travelers for a Transaction in relation to that Trip to obtain consent from them for such change. If any Co-Traveler refuses to such change and declines to travel then that Co-Traveler will be entitled to a full refund of his Cost Contribution and no compensation will be paid to the Ride Offeror in this scenario.
    11. (k) Offeror will not charge additionally at boarding or over what is listed on the Application, in case of breach Ryde reserves right to block or prohibit offeror from offering Rydes on the App;
    12. (l) In case the Ryde owner prefers cash on delivery or the Co-Traveler has selected Cash On Delivery(COD) as the payment option then it is the Ryde Owner's responsibility to collect the amount in cash from the Co-Traveler at the time of the Journey or at the time of dropping off.
    13. (m) It is strongly advised that Ryde Owners use the Start - Stop feature provided in the app at the beginning and the end of the journey to avoid any unnecessary delay in their payouts. The prompt and active use of the feature will help us release your payouts quickly and seamlessly.
  1. 5.2 Covenants and obligations of the Co-Traveler:
  2. The Co-Traveler hereby covenants that:
    1. (a) the Trip is undertaken in his personal capacity in accordance with his need and car sharing shall not be accepted for hire or reward or for profit making in any commercial context;
    2. (b) he will not use RYDE for any commercial purpose and/or for any other purpose which is unlawful or illegal under any law for the time being in force within or outside the territory of India for any fraudulent, unlawful or criminal activity;
    3. (c) he will arrive on time at the appointed pick up place as mutually agreed with Ride Offeror;
    4. (d) he shall wait for the Ride Offeror at the appointed pick up place for at least 10 (ten) minutes after the agreed time if Ride Offeror fails to reach the appointed place on time;
    5. (e) he must take reasonable care to ensure good and humble conduct with the Co-Traveler during the Trip. Improper conduct means use of abusive language, driving under the influence of alcohol/drugs, driving rashly etc:
    6. (f) he will pay his share of Cost Contribution of the Trip at the time of booking the Trip to the Company.
    7. (g) he will immediately inform the Ride Offeror in case he is required to cancel the Trip. In such a situation, Co-Traveler will be entitled to refund as per the cancellation policy of the Company as detailed in Clause 3.3 above.
    8. (h) No promo codes/discount coupons will be applicable/valid on Cash On Delivery(COD) mode of payment. Queries/complaints related to this shall not be entertained.

6. Disclaimer of warranties and no liability of Company:

  1. 6.1 User acknowledges that the Company is acting as a facilitator while providing the Services on RYDE. It is as an online platform for Users who want to pool a car within the city or inter-city in India. The Services offered through or via RYDE is provided on "as is" basis without any representation or warranty of any kind from the Company, either expressed or implied, including without limitation, any representation or warranty for timeliness, safety, continuity, uninterrupted travel, quality, conditions of Vehicle, driving skill, performance for any particular purpose with respect to the Trip.

  3. 6.2 User agrees that the Company doesn't control the Cost of Trip offered through RYDE or any conditions or terms of the Trip as same are agreed and negotiated by the Ride Offeror and Co-Traveler on their own and these are strictly within the control of the Ride Offeror and Co-Traveler only. Users may access the Services on RYDE at their own risk and using their best and prudent judgment before entering into any arrangement with other Users through RYDE.

  5. 6.3 User agrees that the Company is acting as a passive conduit between the Ride Offeror and Co-Traveler and the Company does not have any control and does not determine or advise or in any way involve itself in the offering or acceptance of such commercial and/or contractual terms between the Ride Offeror and the Co-Traveler. User further accepts that the Company shall not be responsible in any manner for any quality or performance or unsatisfactory or delayed performance by Ride Offeror and/or Co-Travelers on the Trip.

  7. 6.4 Company gives no warranty or assurance in regard to insurance and pollution control certificate obtained or to be obtained by the Ride Offeror as provided in Clause 5.1 (d) and (e) above and it is the Co-Traveler's responsibility to verify that insurance procured by the Ride Offeror provides adequate cover to third party.

  9. 6.5 The Company endeavors to provide information which is accurate, complete, and reliable posted on RYDE. However, Company makes no representation about correctness of the Registration Data available on RYDE or any other information published on RYDE at any point of time. All information, picture(s), graphics, content is provided "as is" without warranty of any kind, either express or implied by Company on RYDE.

7. Indemnity:

  1. 7.1 Users agree to indemnify and hold harmless the Company, its affiliates, franchisees and any of their respective directors, officers, employees, agents, licensees or other representatives from and against all claims, liability and expenses, including all legal fees and costs arising from or in relation to (a) breach of the T&Cs by the Users; and (b) use of RYDE including transmission or modification of Registration Data or any other information by the Users on RYDE; and (c) consequences of any acts or omissions by Users and claims or demands under any statute, contract or otherwise in relation to Trip or Services provided herein. This provision shall survive the termination of User's right to use RYDE.

  3. 7.2 The User has discharged the Company, their affiliates, and their respective directors, officers, employees, and agents from any and all claims, liability, loss, or damage, including any third party claims, arising from or relating to, in whole or in part, the Services, or the use, misuse of, or inability to use the Services as contemplated on RYDE.

8. Intellectual property rights:

  1. 8.1 The information displayed on or contained on RYDE including, without limitation, RYDE software, design, text, editorial materials, informational text, images, artwork and other graphic materials, names, logos including all other rights, tangible and intangible with regard to the Services belongs exclusively to the Company and Company is merely permitting Users to use the Services for Ride Offerors and Co-Travelers for a Transaction in exchange for sharing the Cost of the Trip between the Ride Offeror and the Co-Traveler.

9. Confidentiality :

  1. 9.1 Users shall be responsible for maintaining the confidentiality of his user ID and password created at the time of registration and User shall be fully responsible for all the activities that occur under his User Account at all times.

10. Miscellaneous:

  1. 10.1 Applicable Laws and jurisdiction:
  2. The T&C shall be governed by and construed in accordance with the laws of India and the Parties agree that any disputes arising in relation to these T&C shall be subject to exclusive jurisdiction of the competent courts at New Delhi only.

  3. 10.2 Management of disputes
  4. The Company may at its sole discretion provide Users with an online service for resolving disputes. This service is non-binding and Company is under no obligation to resolve disputes between Users and the dispute resolution mechanism may be opted and offered by Company at its sole discretion which may be withdrawn at any time.

  5. 10.3 Compliance with privacy policy and cookies policy:
  6. User agrees that along with the T&C, User shall also be subject to Company's Privacy Policy and Cookies Policy.

  7. 10.4 No Partnership
  8. None of the provisions of the T&C, notices or the right to use RYDE by the Users shall be deemed to constitute a partnership between the Users and the Company.

11. Offers and Discounts :

  1. 11.1 Refer and Earn
    1. a. Anyone who signs-up using a referral code will get a free ryde / discount worth the value of the referral program running at the time of sign-up. These values may change at any given point of time if our referral program changes during the sign-up.
    2. b. Referrer too will receive a free ryde / discount depending on the referral program that is running when your friend signs-up once he/she completes the first ryde.
    3. c. If the referred person cancels the ryde (which was booked using the referral code) on his/her own then the company reserves the right to not to refund the referral/promo code.
    4. d. Ibibo reserves the right to change the referral scheme at any time.
    5. e. Multiple accounts with one email address, fake email IDs, manipulated devices or device IDs, fake device IDs & usage of fake locations is a violation of our policy and can render your account invalid for any referral, promotional scheme or usage of our service.
    6. f. Ibibo reserves the right to revoke the free ryde / discount coupons or suspend your account at any time if we feel that the account is being misused or that our referral program is being violated
    7. g. Company may at its discretion offer certain discounts / promotional codes from time to time which may be availed on RYDE by users. Company reserves the right to modify, alter, amend, change or supplement terms of such offers and promotions for regulatory, legal, technical or any other reason with immediate effect without any prior notice.
    8. h. Company reserves the right to validate any Transaction completed by a User/Co-Traveller using RYDE. In case any Transaction made by User is found to be fraudulent in nature, User shall be liable to charges with respect to fraudulent Transaction in its next Trip. Decision of Company shall be final and binding in this regards.

  2. 11.2 Sales Discount
    1. a. Ibibo may offer discounts to co-travelers on Ryde to avail bookings by reducing the price offered by offeror with or without intimating offeror. However, offeror will get full amount after completion of the Ryde.
    2. b. Ibibo reserves the right to change, alter, remove or modify the discount amount at any time.

12. Ryde Selfies :

  1. 1. All the steps written in the SMS need to be complete for the code to be unlocked.
  2. 2. Once a user's selfie is validated, the exclusive activated Promo Code will be shared with him/her via SMS.
  3. 3. The Promo Code will be valid for the communicated time in the message along with the Code.
  4. 4. One Promo Code is valid for only one journey.
  5. 5. Same selfie posted on the pages more than once will be counted as 1.
  6. 6. To be eligible, Min followers on Twitter should be: 50 | Min friends on Facebook should be: 100

13. Payout: Do's & Don'ts

  1. While we strive continuously to make your everyday travel hassle free, we sometimes have to take certain measures to keep our community clean and away from any malpractices. We have found some users trying to abuse the system in the past by indulging into fraudulent activities and misuse the various promotional activities run by us. This hampers the genuine users in a big way which is strictly against our policies. Hence, we have laid down some of the malpractices which users might indulge in and which may result in the upholding of their Ryde Payouts permanently. Hence, users are advised to refrain from:

  3. 1. Furnishing somebody else's account to transfer the earned money.
  4. 2. Booking multiple seats/rydes under one name.
  5. 3. Booking seat/ryde for somebody else.
  6. 4. Multiple accounts with same email address, fake email IDs, same mobile number on multiple device IDs & usage of fake locations is a violation of our policy and can render your account invalid for any referral, promotional scheme or usage of our service.
  7. 5. Creating multiple accounts to abuse promotional discounts.
  8. 6. Transacting to earn the promo amount within the friends/family/close group, without actually travelling hence defeating the purpose of introducing the Referral codes.

  10. Company reserves the right to validate any Transaction completed by a User/Co-Traveller using RYDE. In case any Transaction made by User is found to be fraudulent in nature, User shall be liable to charges with respect to fraudulent Transaction in its next Trip. Decision of Company shall be final and binding in this regards.
